French Regulation

The principles of the law concerning outbound calls in France are based on the respect of privacy and transparency. These principles are regulated by the Act of January 6, 1978.

As a result, an independent administrative authority has formed: CNIL (The National Commission for Data protection and the Liberties). CNIL has specified that telemarketing is possible only if the called person

  • is informed about the further use of his/her personal data; 
  • has the possibility to oppose to the use of his/her personal data in a simple and free of charge mode.

Any pre-recorded message must

  • inform about the identity of the organization on whose behalf the call is being made; 
  • propose a simple, free of charge mode to refuse other eventual calls from that organization.

Self regulatory codes are also applicable and effective to insure smooth telemarketing experience and customers’ privacy protection. The most important is the Code of Ethics published by the Telephone Marketing Union.

In France there are several Do Not Call lists and all telemarketing companies must regularly check up with them.

"Orange List"

The “liste orange” contains the telephone numbers of people, who do not wish their data to be used for direct marketing purposes. Nevertheless, their contact numbers remain available through paper, telephone or digital directory.

"Robinson List"

The Robinson list references all French opposing the use of their information for direct marketing purposes, regardless of the means used (mail, telephone, email, cell phone, etc.)

"Red List"

The “liste rouge” references France Telecom subscribers resisting disclosure of their contact information for direct marketing purposes.

Breach fines are severe and range from € 750 (per call penalty for the use of numbers on the “liste orange”) up to € 300 000 and even imprisonment.
